LGPD Issues and Compliance

The GDPR came into effect in September 2020, requiring all companies to comply with the law and process personal data in an appropriate manner to protect information and preserve user privacy.

The law posed several challenges for companies to comply with. Initially, it was emphasized that the LGPD project should be interdisciplinary, including areas such as technology and information security, operations management, and key legal and business areas that interact with data subjects on a daily basis.

The solutions expected from the implementation of the LGPD must be aligned with the company's compliance, which is a set of professional and corporate ethics and discipline aimed at regulatory compliance, risk reduction and security.

In order to comply with the requirements of the LGPD, it is necessary to rework the internal procedures, define the personal data to be processed, with an appropriate legal framework that ensures correct and safe processing, and to develop policies and procedures that can mitigate the risks of data processing, while taking into account business specificities.

However, compliance is fraught with other challenges, the most important of which is the changing culture of professionals who process personal data in their daily lives.

Defining the data to be processed, changing internal processes and informing employees of the need to process data in a safe manner, with pre-defined procedures and in accordance with the law, is a major challenge for companies, but this is one of the methods that must be followed to achieve consistency between LGPD and compliance.
